Regulatory Compliance Policy for Toll-Free Text Messaging
At Infinite Power Consulting, we are committed to responsible, transparent, and fully compliant text messaging practices. When using toll-free numbers (such as 800, 888, 877, etc.) for SMS/MMS communications in the United States and Canada, we adhere strictly to all applicable federal regulations, industry standards, and carrier requirements as outlined by Twilio and governing bodies like the FCC and CTIA.
Toll-Free Number Verification Requirement
Effective January 31, 2024, all toll-free numbers used for messaging must undergo Toll-Free Verification through Twilio before any messages can be sent to U.S. or Canadian recipients. Unverified or pending numbers are blocked from sending messages.
We complete this verification process for every toll-free number we use, providing accurate business information, use case details, and supporting documentation. As of 2026, this process also requires a Business Registration Number (such as an EIN) for added security and legitimacy.
Verified toll-free numbers help reduce message filtering, improve deliverability, and demonstrate our commitment to trusted communications.
Consent Requirements
We never send unsolicited text messages. Prior to sending any SMS or MMS from a toll-free number, we obtain clear, informed, and unambiguous prior express consent from the recipient. This consent must meet or exceed Twilio’s Messaging Policy and TCPA/CTIA guidelines.
Consent must include:
– The identity of the sender (Infinite Power Consulting or our authorized client/brand)
– A clear description of the types of messages the recipient will receive
– How the phone number will be used
– Information on how to opt out at any time
Consent can be obtained via web form, email, verbal agreement (with proper documentation), or other non-SMS methods. Blanket or third-party consents are not accepted. We proactively reconfirm consent when required (for example, after significant time has passed or if message content changes).
Opt-Out and Revocation of Consent
Recipients can opt out at any time by replying with standard commands such as STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. We honor all opt-out requests immediately and do not send further messages to that number (except for a single confirmation reply where appropriate).
Twilio automatically processes these opt-outs for toll-free numbers in accordance with industry standards. We maintain internal do-not-contact lists and respect any reasonable opt-out method as required by the FCC.
Prohibited Content and Use Cases
We strictly prohibit the use of toll-free numbers for any content or campaigns that violate Twilio’s Messaging Policy, Acceptable Use Policy, or applicable laws. This includes (but is not limited to):
– Spam or unsolicited marketing
– Fraudulent, deceptive, or harmful content
– Illegal activities
– High-risk financial services without proper authorization
– Content that carriers or regulators deem inappropriate
All messaging campaigns must align with approved use cases suitable for toll-free numbers, such as customer support, transactional notifications, and account-related communications. Marketing or high-volume promotional messaging may require additional review.
Best Practices for High Deliverability
To ensure reliable delivery and maintain compliance:
– Use clear, branded, and concise messaging
– Include easy opt-out instructions in every message when required
– Employ shortened, branded URLs for any links
– Keep opt-out rates very low through respectful and relevant communications
– Monitor and respond promptly to any carrier feedback or filtering issues
We regularly review our practices against Twilio’s guidelines for toll-free SMS in the US and Canada.
Our Commitment to Ongoing Compliance
Infinite Power Consulting partners with Twilio to ensure all toll-free text messaging activities remain compliant with evolving regulations. We do not send messages from unverified toll-free numbers and maintain detailed records of consents, opt-outs, and campaign details.
